2. BABY CAR SEAT RENTAL SERVICE

BABY ON BOARD provides baby car seat rental and child car seat rental services for customers travelling by rental car and other mobility services, subject to availability.

The Equipment supplied will correspond to the category, age/size range and essential characteristics selected during the booking process. Where the selected brand or model is unavailable, BABY ON BOARD may provide an equivalent or higher-specification baby car seat or child car seat.

Images shown on the website are for illustration purposes. The actual Equipment supplied may differ in brand, colour or model, provided that its essential characteristics and applicable safety requirements are equivalent or superior.

All Equipment supplied by BABY ON BOARD is inspected, cleaned and hygienically prepared before rental.

3. ELIGIBILITY AND CUSTOMER RESPONSIBILITY

The customer is responsible for selecting Equipment suitable for the child, taking into account the child’s age, height, weight and the requirements of the applicable child restraint system.

The customer is also responsible for confirming that the selected Equipment is compatible with the vehicle in which it will be installed.

BABY ON BOARD may provide general product information, but the customer remains responsible for ensuring that the baby car seat or child car seat selected and installed is appropriate for the child and vehicle.

4. RESERVATION AND CONTRACT FORMATION

A reservation is completed only when:

  • the customer has provided the required information;
  • the customer has accepted these Terms and Conditions; and
  • payment has been successfully completed.

Once the reservation has been confirmed, BABY ON BOARD will send a booking confirmation by email.

The booking confirmation will normally include the reservation number, rental period, collection and return details, Equipment category and total price.

The customer is responsible for checking the accuracy of all information contained in the booking confirmation and for immediately notifying BABY ON BOARD of any error.

5. RENTAL PERIOD

The rental period is the period stated in the booking confirmation. The maximum rental period for any baby car seat or child car seat rented from BABY ON BOARD is 30 consecutive days. Any rental period exceeding 30 days requires a separate agreement with BABY ON BOARD.

The Equipment must be returned at the date, time and location specified in the reservation.

If the customer wishes to extend the rental period, the extension must be requested and approved by BABY ON BOARD in advance. Extensions are subject to availability and may result in additional rental charges.

Keeping the Equipment beyond the agreed rental period without prior approval may be treated as unauthorised retention of the Equipment and may result in additional charges and recovery costs.

6. COLLECTION AND RETURN OF BABY CAR SEATS

The customer must collect and return the Equipment at the location and during the opening hours stated in the booking confirmation.

At collection, the customer should check that the Equipment supplied corresponds to the reservation and that there are no immediately apparent defects or missing accessories.

The customer must return the baby car seat or child car seat complete, together with all accessories and components supplied with it, and in a condition consistent with normal and proper use.

BABY ON BOARD may inspect the Equipment after its return. Where a condition issue is identified after return, BABY ON BOARD may contact the customer and provide reasonable information concerning the issue and any applicable charge.

7. CORRECT AND SAFE USE

The Equipment must be used strictly in accordance with the manufacturer’s instructions and applicable child restraint requirements.

The customer must ensure that:

  • the baby car seat or child car seat is correctly installed in the vehicle;
  • the child is within the applicable height, weight and/or age range for the Equipment;
  • the child is correctly positioned and secured;
  • harnesses, belts, ISOFIX systems and other restraint systems are correctly adjusted and secured; and
  • the Equipment is used only for its intended purpose.

The customer must not use the Equipment if they become aware of a defect or condition that could affect its safe use and must contact BABY ON BOARD immediately.

BABY ON BOARD is not responsible for loss or damage arising from incorrect installation, misuse, failure to follow the manufacturer’s instructions, or use of the Equipment in circumstances for which it was not designed, except to the extent that such liability cannot lawfully be excluded or limited.

8. NO MODIFICATION OR UNAUTHORISED REPAIR

The customer must not dismantle, modify, repair, alter or adapt the Equipment, remove safety labels or identification marks, replace components, or use accessories that have not been supplied or expressly approved by BABY ON BOARD.

Any unauthorised modification, repair or alteration may result in charges for inspection, repair, replacement or loss of use.

9. ONLINE PAYMENT – NO CASH PAYMENTS

Payment for baby car seat rental must be made online through the payment methods made available on the BABY ON BOARD website.

BABY ON BOARD does not accept cash payments for online reservations, collection or return of Equipment.

The rental price, applicable taxes and any mandatory charges will be displayed before the customer completes the booking.

Unless expressly stated otherwise, the full rental price must be paid before the rental period begins.

A reservation is not confirmed until payment has been successfully authorised and received.

10. SECURITY DEPOSIT AND PAYMENT AUTHORISATION

Where applicable, BABY ON BOARD may require a security deposit or a pre-authorisation on a credit card at the time the Equipment is collected. The pre-authorisation may be requested at the collection of the baby car seat or child car seat and will be made against the customer’s credit card.

The amount and method of any security deposit or payment authorisation will be disclosed to the customer before the reservation is completed.

Subject to applicable law, the security deposit or credit card authorisation may be used to secure amounts properly due under the rental agreement, including charges arising from loss, theft, non-return, damage or missing components.

  • loss, theft or non-return of Equipment;
  • damage beyond normal wear and tear;
  • missing components or accessories;
  • extraordinary cleaning;
  • unauthorised extension of the rental period; or
  • reasonable recovery or replacement costs.

Where no amount is due, the relevant deposit or payment authorisation will be released in accordance with the procedures and timescales of the applicable payment provider.

11. CANCELLATION BY THE CUSTOMER

Unless a different cancellation policy is expressly stated during the booking process, the following cancellation policy applies:

  • Cancellation 48 hours or more before the scheduled collection time: full refund of the amount paid.
  • Cancellation less than 48 hours before the scheduled collection time: 50% of the rental price will be refunded.
  • Cancellation less than 24 hours before the scheduled collection time: no refund will be due.
  • No-show: no refund will be due.

For the purpose of this section, the relevant time is the local time at the collection location.

If a booking is made through a BABY ON BOARD mobility partner or another third-party booking channel, the cancellation terms expressly applicable to that booking may apply instead.

Nothing in this section affects any mandatory consumer cancellation or withdrawal rights that cannot lawfully be excluded.

12. CHANGES TO A RESERVATION

Requests to change the rental dates, collection location, return location, Equipment category or quantity are subject to availability and must be approved by BABY ON BOARD.

A change may result in an adjustment to the rental price.

BABY ON BOARD cannot guarantee that a requested change will be possible, particularly during periods of high demand.

13. EARLY RETURN

If the customer returns the Equipment before the agreed return date, no automatic refund will be due for the unused portion of the rental period.

Any refund will be considered in accordance with the cancellation terms applicable to the reservation and any mandatory rights provided by law.

14. LOSS, THEFT AND NON-RETURN OF EQUIPMENT

BABY ON BOARD baby car seats and child car seats remain the property of BABY ON BOARD or its relevant equipment owner at all times.

The customer is responsible for the Equipment during the rental period and until it has been returned to BABY ON BOARD or its authorised collection partner.

In the event of loss, theft, disappearance or non-return, the customer must notify BABY ON BOARD immediately and, where appropriate, report the incident to the competent authorities.

In the event of theft, loss, non-return or damage to a baby car seat or child car seat, BABY ON BOARD may charge a fixed amount of €150 plus applicable VAT per affected item of Equipment, subject to applicable law. Where only a component or accessory is missing or damaged, BABY ON BOARD may charge the reasonable cost of repairing or replacing that component or accessory, up to a maximum of €150 plus applicable VAT per affected item of Equipment, subject to applicable law.

  • the applicable additional rental charges until the Equipment is recovered, where appropriate;
  • reasonable costs incurred in recovering the Equipment; and/or
  • the reasonable replacement value of the Equipment where it cannot be recovered.

The €150 plus applicable VAT charge per affected item of Equipment is intended to cover reasonable administrative, handling, recovery and/or replacement costs associated with the loss, theft, non-return or damage of the Equipment. Where only a component or accessory is affected, the charge will reflect the reasonable cost of repairing or replacing that component or accessory, subject to the maximum amount stated above. Where applicable law requires otherwise, the amount charged will be adjusted accordingly.

BABY ON BOARD will not impose an arbitrary penalty solely because Equipment has not been returned. Any amount charged will be limited to amounts reasonably attributable to the loss, non-return, recovery or replacement of the Equipment, subject to applicable law.

15. DAMAGE TO EQUIPMENT

The customer must return the Equipment in the condition in which it was supplied, allowing for normal wear and tear resulting from proper use.

The customer may be charged for damage caused by misuse, negligence, accident, unauthorised modification, improper storage, inappropriate use, or any other circumstance attributable to the customer’s use of the Equipment, to the extent permitted by law.

For the avoidance of doubt, where a baby car seat or child car seat is lost, stolen, not returned or damaged beyond normal wear and tear, BABY ON BOARD may charge €150 plus applicable VAT per affected item of Equipment. Where only a component or accessory is affected, BABY ON BOARD may charge the reasonable cost of repairing or replacing that component or accessory, up to a maximum of €150 plus applicable VAT per affected item of Equipment, subject to applicable law.

Normal wear and tear will not be treated as chargeable damage.

Where a damage charge is made, BABY ON BOARD will, where reasonably possible, provide information or evidence describing the damage and the basis of the applicable charge.

16. CLEANING AND HYGIENE

BABY ON BOARD supplies baby car seats and child car seats in a clean and hygienically prepared condition.

Normal use by a child may result in ordinary marks or soiling and will not automatically result in a cleaning charge.

Extraordinary cleaning may be charged where the Equipment is returned with substantial contamination, stains, bodily fluids, food residue or other conditions requiring cleaning beyond the normal cleaning and hygiene process.

Any cleaning charge will reflect the reasonable cost of the additional cleaning required.

17. MISSING ACCESSORIES AND COMPONENTS

The Equipment may be supplied with accessories or components including, depending on the model:

  • ISOFIX bases;
  • infant inserts or reducers;
  • covers or pads;
  • installation components;
  • protective accessories; and
  • other manufacturer-supplied components.

If any component or accessory is missing on return, BABY ON BOARD may charge the reasonable cost of replacement, subject to applicable law.

18. EQUIPMENT AVAILABILITY AND SUBSTITUTION

BABY ON BOARD takes reasonable steps to ensure that the Equipment reserved is available at the agreed collection time.

In exceptional circumstances, including damage, loss, safety concerns, operational disruption or circumstances outside BABY ON BOARD’s reasonable control, the exact model or brand reserved may not be available.

In such circumstances, BABY ON BOARD may provide an equivalent or superior baby car seat or child car seat at no additional rental cost.

If no suitable alternative is available, BABY ON BOARD will refund the amount paid for the affected Equipment.

19. RESPONSIBILITY AND LIMITATION OF LIABILITY

BABY ON BOARD is responsible for providing the rental service and Equipment in accordance with the booking and applicable law.

BABY ON BOARD is not responsible for loss or damage resulting from:

  • incorrect installation or use of the Equipment;
  • failure to follow the manufacturer’s instructions;
  • use of Equipment outside its intended purpose;
  • use of unauthorised accessories;
  • acts or omissions of the customer or third parties; or
  • circumstances outside BABY ON BOARD’s reasonable control,

except where such loss or damage results from BABY ON BOARD’s breach of its legal obligations or from liability that cannot lawfully be excluded or limited.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

20. CANCELLATION BY BABY ON BOARD

BABY ON BOARD may cancel a reservation where:

  • payment has not been successfully completed;
  • the Equipment is unavailable due to exceptional circumstances;
  • there is a reasonable suspicion of fraud or misuse;
  • material information supplied by the customer is incorrect; or
  • circumstances beyond BABY ON BOARD’s reasonable control prevent the rental service from being provided.

Where BABY ON BOARD cancels a reservation for reasons attributable to BABY ON BOARD and the service cannot be provided, the customer will receive a refund of amounts paid for the affected service.

This does not affect any mandatory legal rights of the customer.

21. COMPLAINTS AND CUSTOMER SUPPORT

Customers should contact BABY ON BOARD as soon as reasonably possible if they experience a problem with the Equipment or rental service.

Where a safety or equipment issue is identified at collection, the customer should contact BABY ON BOARD before using the Equipment whenever reasonably possible.

BABY ON BOARD will use reasonable efforts to investigate and resolve complaints promptly.

22. CONSUMER CANCELLATION / RIGHT OF WITHDRAWAL

Where applicable, consumers have the rights provided by mandatory Portuguese and European consumer protection legislation in relation to contracts concluded online or at a distance.

The customer will be informed before completing the booking where a statutory exception to a right of withdrawal or cancellation applies.

Nothing in these Terms and Conditions is intended to remove or restrict any mandatory consumer right.

23. PERSONAL DATA AND PRIVACY

Personal data provided during a reservation will be processed in accordance with the BABY ON BOARD Privacy Policy.

Personal data may be processed for the purposes of processing reservations and payments, providing and managing baby car seat rental services, customer support, fraud prevention, equipment management and compliance with legal obligations.

Further information is available in the BABY ON BOARD Privacy Policy.

24. GOVERNING LAW AND CONSUMER RIGHTS

These Terms and Conditions are governed by Portuguese law, unless mandatory consumer protection legislation provides otherwise.

Nothing in these Terms and Conditions limits any mandatory rights available to consumers under the laws applicable to their situation.

Any dispute will be handled in accordance with the applicable legal rules concerning jurisdiction and consumer protection.
